Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the compINSITE platform operated by The AI Expedition LLC, DBA compINSITE (“compINSITE,” “we,” “us,” or “our”) at compinsite.com. By creating an account or using our services, you agree to be bound by these Terms.
If you do not agree to these Terms, do not use compINSITE.
1. Overview of Services
compINSITE is a hospitality analytics platform that provides competitive benchmarking and market share analysis for hotel operators. Our platform processes publicly available Texas Comptroller hotel occupancy tax receipt data to calculate Revenue Per Available Room (RevPAR) and related performance metrics for lodging properties across Texas.
1.1 Data Source and Limitations
All analytics data in compINSITE is derived from public records filed with the Texas Comptroller of Public Accounts. This data includes total room receipts (revenue) and unit capacity (room count) reported monthly by lodging properties.
Because the source data is limited to these two fields, compINSITE provides RevPAR-based metrics only. Occupancy rates, Average Daily Rate (ADR), and daily or weekly granularity are not available and are not represented in our platform.
1.2 Property Names and Public Record
compINSITE publishes individual property names in rankings and reports. This is possible because the underlying data is public record under Texas law. By using compINSITE, you acknowledge that named property performance data visible within the platform is derived from publicly available government records.
2. Account Registration
2.1 Eligibility
compINSITE is a business-to-business platform intended for hotel industry professionals, including general managers, revenue managers, asset managers, management companies, and real estate developers. You must be at least 18 years of age to create an account.
2.2 Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at connect@compinsite.com if you suspect unauthorized access to your account.
2.3 Accuracy of Information
You agree to provide accurate, current, and complete information during registration and to update your information as needed to keep it accurate.
3. Subscription Plans and Billing
3.1 Plans
compINSITE offers multiple subscription tiers with varying levels of access to properties, competitive sets, dashboards, and reports. Plan details and pricing are displayed on our website and during the onboarding process.
3.2 Billing
Subscriptions are billed on a recurring basis (monthly or annually) through our payment processor, Stripe. By subscribing, you authorize us to charge your designated payment method at the applicable rate for your selected plan and billing interval.
All prices are listed in U.S. dollars. Applicable taxes (including Texas sales tax) are calculated and collected automatically by Stripe at checkout and on invoices.
3.3 Plan Changes
You may upgrade or downgrade your subscription plan at any time through your account settings. Upgrades take effect immediately, and you will be charged a prorated amount for the remainder of the current billing period. Downgrades take effect at the end of the current billing period.
3.4 Pay-Per-Use Reports
Certain features within the Performance Lab (such as Market Share reports) are available as individual paid reports in addition to your subscription. Pricing for these reports is displayed before purchase. Pay-per-use charges are one-time and non-refundable once the report has been generated.
3.5 Cancellation
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — you will retain access until that date. We do not provide prorated refunds for partial billing periods.
3.6 Payment Failures
If a payment fails, we will attempt to collect the outstanding amount in accordance with Stripe’s retry schedule. During this period, your access may be restricted. If payment is not resolved, your subscription may be suspended or canceled.
4. Acceptable Use
You agree to use compINSITE only for lawful purposes and in compliance with these Terms. You agree not to:
- Share, redistribute, or resell compINSITE data, reports, or exports to third parties for commercial purposes without our written consent.
- Scrape, crawl, or use automated means to extract data from the platform beyond normal use of provided export features.
- Attempt to gain unauthorized access to our systems, other users’ accounts, or any part of the platform not intended for your use.
- Interfere with or disrupt the platform’s infrastructure, security, or performance.
- Use the platform in any way that violates applicable local, state, or federal law.
4.1 Report and Export Use
Reports and data exports generated through compINSITE are licensed for your internal business use. You may share reports within your organization and with your direct stakeholders (owners, investors, lenders) in the normal course of business. You may not publish compINSITE reports or data publicly or distribute them commercially without our prior written consent.
5. Intellectual Property
5.1 Our Property
The compINSITE platform, including its design, features, code, branding, documentation, and proprietary analytics methodologies, is owned by The AI Expedition LLC and is protected by applicable intellectual property laws. These Terms do not grant you any ownership interest in the platform.
5.2 Public Data
The underlying hotel occupancy tax data is public record and is not owned by compINSITE. Our value lies in the aggregation, classification, analysis, and presentation of that data — not the raw data itself.
5.3 Your Content
Any data you input into the platform (such as property configurations and report names) remains yours. We do not claim ownership of your account content. However, you grant us a limited license to use that content as necessary to provide and improve our services.
6. Data Accuracy and Disclaimers
6.1 Data Source Reliance
compINSITE relies on data published by the Texas Comptroller of Public Accounts. While we take reasonable steps to ensure accuracy in our processing and presentation, we do not guarantee that the source data is free from errors, omissions, or delays.
6.2 Not Financial or Investment Advice
compINSITE provides analytical tools and competitive benchmarks for informational purposes. Nothing in our platform constitutes financial advice, investment advice, or a recommendation to buy, sell, or hold any asset. You are solely responsible for any business decisions made using compINSITE data.
6.3 No Warranty
The compINSITE platform is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the platform will be uninterrupted, error-free, or completely secure.
7. Limitation of Liability
To the maximum extent permitted by law, The AI Expedition LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the platform, including but not limited to loss of profits, lost revenue, lost data, or business interruption, regardless of the theory of liability.
Our total liability for any claim arising from these Terms or your use of the platform shall not exceed the amount you paid to compINSITE in the twelve (12) months preceding the claim.
8. Indemnification
You agree to indemnify, defend, and hold harmless The AI Expedition LLC (DBA compINSITE), its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the platform, violation of these Terms, or infringement of any third party’s rights.
9. Beta Program
If you are participating in the compINSITE beta program, the following additional terms apply:
- The beta environment is an active development environment. Features may change, and data may be reset without notice.
- Beta access is provided at no charge or at reduced rates and may be revoked at any time.
- Beta accounts that remain inactive may be deactivated after a period of inactivity.
- Your feedback during the beta period is welcome and appreciated but does not create any obligation on our part to implement suggestions.
10. Termination
10.1 By You
You may close your account at any time by canceling your subscription and contacting us at connect@compinsite.com to request account deletion.
10.2 By Us
We reserve the right to suspend or terminate your account at any time if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or if required by law. In cases of termination for cause, no refund will be provided.
11. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any dispute arising from these Terms or your use of compINSITE shall be resolved in the state or federal courts located in Collin County, Texas.
12. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you by posting the updated Terms on our website and updating the “Last Updated” date above. Your continued use of compINSITE after any changes constitutes your acceptance of the revised Terms.
13. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
14. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and The AI Expedition LLC regarding your use of the platform and supersede any prior agreements or understandings.
